  5. A completed rebate application with a valid customer account number must be accompanied by a legible copy of the paid, itemized sales receipt. The receipt must include the manufacturer, model number, store name, store location, purchase price, and purchase date. Missing or incomplete information may delay processing or result in rejection.
  6. Rebate amounts cannot exceed the total purchase price.
  7. Multiple FirstEnergy rebates will not be applied to the same product. Any product with a previously applied FirstEnergy rebate will be rejected.
  8. Please allow up to 60 calendar days from the date all required information is received for rebate processing. For the fastest possible rebate, please submit your rebate application online at rebates.energysavePA.com.
  9. By submitting this rebate application, you acknowledge that CLEAResult on behalf of FirstEnergy reserves the right to audit this application and, upon request, you will allow a representative of CLEAResult, FirstEnergy, or the Pennsylvania Public Utility Commission (“PA PUC”) reasonable access to verify installation of qualifying product(s). Rebate payment may be withheld if you decline to permit verification within a reasonable period.
  10. Neither CLEAResult nor FirstEnergy, nor any of their respective parents, subsidiaries, affiliates, employees, officers, directors, or agents, assume any responsibility for equipment performance or warranties, the quality of work, labor, or materials supplied, or the acts or omissions of any participating retailer, contractor, or installer. Responsibility for the equipment and its installation rests with the manufacturer, the installing contractor, if applicable, and/or owner of installed equipment.
  11. CLEARESULT AND FIRSTENERGY MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, AND ASSUME NO LIABILITY WITH RESPECT TO THE QUALITY, SAFETY, PERFORMANCE, ENERGY SAVINGS, OR ANY OTHER ASPECT OF ANY PRODUCT PURCHASED OR INSTALLED UNDER THE PROGRAM, AND EXPRESSLY DISCLAIM ALL SUCH REPRESENTATIONS AND WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. OTHER THAN AS EXPRESSLY PROVIDED IN SECTION 15, NOTHING IN THESE TERMS CREATES ANY DUTY OR STANDARD OF CARE OWED TO ANY THIRD PARTY.
  12. THE TOTAL LIABILITY OF CLEARESULT AND FIRSTENERGY ARISING OUT OF OR RELATING TO THE PROGRAM OR THIS APPLICATION, REGARDLESS OF THE FORM OF ACTION, WILL NOT EXCEED THE AMOUNT OF THE REBATE APPLIED FOR. IN NO EVENT WILL CLEARESULT OR FIRSTENERGY BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST SAVINGS.
  13. If a rebate is paid based on information that is inaccurate, incomplete, or fraudulent, or is paid in error or in duplicate, you agree to repay the full amount upon request, and CLEAResult may deny your future participation in the Program.
  14. Information you provide, including your account number, contact information, and any household size and income information, will be used to process and verify your rebate and to administer, evaluate, and report on the Program. CLEAResult will not otherwise disclose your information without your permission.
  15. These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. FirstEnergy and the PA PUC are intended third party beneficiaries of these Terms. You may not assign this application or your rights under it. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. Sections 9 through 16 survive payment or denial of your rebate.

The costs of energy efficiency programs are recovered through customer rates in accordance with PA Act 129 of 2008. For a complete list of commercial, industrial, residential, and low-income energy efficiency programs, please visit energysavePA.com. By participating in these energy efficiency and peak demand reduction programs, customers agree to allow their utility to retain ownership of all Capacity Rights which refers to the demand reduction associated with any energy efficiency and peak demand reduction measure for which incentives were provided by the Company. Your utility will aggregate these energy efficiency demand reduction attributes into the PJM capacity market with proceeds being used to offset the program costs.
